These Terms govern access to and use of Skydiving Winds, including the mobile application, related legal pages and support resources. By downloading, accessing or using the service, you agree to these Terms. If you do not agree, do not use the service.
Skydiving Winds is operated by Bernat Marimon Palarea as an individual developer. Additional mandatory identification details are available in the Legal Notice.
You are responsible for ensuring that your use of the app is lawful in your jurisdiction. If you create an account, you are responsible for keeping your credentials secure and for activity carried out through your account. If you are under the age required to validly use the service or consent under applicable law, use the service only with the authorisation of your parent or legal guardian.
The app provides weather-related information, wind analysis, jump-planning support tools, favourites, profile settings and an optional jump log. The service may evolve, and features may be added, changed, limited or removed.
The app is an informational support tool only. Weather and forecast information may contain errors, delays, outages or local inaccuracies. The app does not replace the judgment of the pilot, instructor, dropzone operations staff, manifest, safety officer or the user’s own assessment. The final decision to jump, postpone or cancel any jump always remains with the user and the competent operational staff.
The app is not certified aviation, meteorological, rescue or emergency software.
You remain responsible for the content you submit, such as jump notes, feedback, profile data, equipment information and dropzone correction suggestions. By submitting content, you grant the operator a non-exclusive right to process it only to provide, secure and improve the service and to answer your requests.
The service is provided on an “as available” basis. Availability, compatibility and continuity are not guaranteed. Maintenance, provider outages, rate limits, bugs, feature flags or platform restrictions may affect the service.
The operator may modify or discontinue parts of the service at any time.
The service depends on third-party providers such as hosting, authentication, weather data, diagnostics or push infrastructure. The operator is not responsible for outages or changes caused by third-party platforms, except as required by non-waivable law.
The Skydiving Winds name, app design, software, visual elements and original content are protected by applicable intellectual property rules. Third-party names, datasets and services remain subject to their own rights and terms.
The operator may suspend, limit or terminate access in cases such as abuse, fraud, security risks, unlawful use, repeated violations of these Terms or behaviour that harms the service or other users.
You may stop using the service at any time and, if you created an account, request deletion using the in-app feature or the web deletion page.
To the fullest extent permitted by law, the operator is not liable for indirect, incidental or consequential damages arising from the use or unavailability of the service. Nothing in these Terms limits liability that cannot be limited under applicable consumer or mandatory law.
These Terms are governed by Spanish law and, where applicable, EU law. If you are a consumer, mandatory consumer jurisdiction rules continue to apply. If you are not a consumer and applicable law allows it, disputes may be submitted to the courts of Spain.
